Elevator Accident
$6.4 Million was recovered after a Jury Trial and an appeal to the Court of Appeals, for a 60 year old truck driver who was injured in an elevator accident, had complex spinal reconstructive surgery, and was permanently disabled from working again as a truck driver. The opinion of the Court of Appeals in this case was a victory for consumers. The building owner tried to escape responsibility for its dangerous elevator by blaming the elevator company. The Court upheld the Non-delegable Duty Doctrine in this case, which requires building owners to keep their buildings safe, and exercise the highest degree of caution in operating its elevators, as they are common carriers of passengers. Car Crash
$3.1 Million was recovered for a young woman who was paralyzed in a head-on car crash. This was an exceptional settlement of a catastrophic personal injury case because the driver that caused the accident driving the wrong way on the freeway had only $30,000 of insurance. The $3,000,000 was recovered against Kaiser Permanente who had failed to report to the DMV that their patient had seizure disorder. The DMV could not take away the license of the driver who had a seizure disorder because the doctors failed to report as the law required. This led to the sick woman driving on the highway.
